Our Terms of Service ::

Hosting Services:

  1. Service Rates: Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that Cybervox Network Limited (CNL) may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon CNL achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.

  2. Establishment of this service is dependent upon receipt by CNL of payment of stated charges. Subsequent payments are due on the anniversary date of account creation.

  3. Payments and Fees: Payment is due when the prior billing period completes. If payment is not made within 10 days after due date, the account may be suspended and a setup fee will be required. If payment is not made in full within 20 days of the end of the prior billing period, the account will be closed. CNL will not be responsible at this point to maintain user’s files on the server. If client wishes to reopen their account or would like to open a new account, they must first pay any past due accounts. After 20 days, setup fees (if any) will again be required. If you desire to cancel your account, please follow the proper procedure to do this as outlined in this TOS.

  4. Refund and Disputes: After the first 30 days (guarantee), all payments to CNL are nonrefundable. This includes the one time setup fee and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 30 days of the time the dispute occurred.

  5. Account Cancellation: All requests for canceling accounts must be emailed to cancellation@
    virtualvox.com
    . Please include your full name, your primary email address, as well as your account login information. Cancellations will not become effective until the termination of the current payment period and no refunds will be made. Accounts will not be prorated for unused portions of service.

  6. Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of CNL and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that CNL shall not be liable for any damages arising from such causes beyond the direct and exclusive control of CNL. Subscriber further acknowledges that CNL’s liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall CNL be liable for any special or consequential damages, loss or injury.

  7. New Domain Accounts: All new web hosting accounts involving new domains will be set up and entered into our DNS servers within 1 to 3 business days. Due to unforeseen complications, however, this process may sometimes require up to 7 business days.

  8. Transfer of Domains: New web hosting accounts which involve the transfer of a domain from another provider to CNL will require a minimum of two (2) days to be set up and entered into our DNS servers. In some rare cases, such transfers may take up to sixty (60) days. Due to the unpredictable nature of the transfer process, no guarantees can be made regarding the amount of time a specific transfer may take.

  9. Support Boundaries: We limit our technical support to our area of expertise. The following is our guidelines when providing support: CNL provides support related to your website’s physical functioning. CNL does not offer tech support for application specific issues such as cgi programming, html or any other such issue. CNL does not provide technical support for YOUR customers. If you can email, we encourage you to email support@virtualvox.com for assistance. If you are able to get online and have other questions, the answers may be in our FAQ page at http://www.virtualvox.com/faq - we encourage you to check there first. Lastly, the Help files in the program you are using may have the answer to your question so please do investigate these resources before emailing tech support.

  10. SPAM and Unsolicited Commercial Email (UCE): CNL takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of CNL may not use or permit others to use our network to transact in UCE. Customers of CNL may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service. PLEASE, DO NOT SPAM from your account.

  11. Bulk Mailing: The above is only for communication services from one individual to another individual - not to a large group (defined as more than 15-20 emails at one time, or more than 50 emails in a given day containing the same subject matter). The client would not use any specific programs that are designed to fool the mail server into allowing multiple small mailings at a time.  If he were in need of mass mailings of this nature he would take extra services like specific mailing list services available by VirtualVox.

  12. Privacy and encryption: The electronic mail passes through multiple mail servers on the Internet as it passes from source to destination. CNL can never guarantee privacy from every possible mail server; therefore, if the client seeks for total privacy he will have to use some encryption scheme to render their messages unreadable by eavesdroppers.

  13. Bandwidth and Disk Usage: Customer agrees that bandwidth and disk usage shall not exceed the number of megabytes per month for the Services ordered by Customer on the Order Form. CNL will monitor Customer’s bandwidth and disk usage. CNL shall have the right to take corrective action if Customer’s bandwidth or disk usage exceeds the Agreed Usage. Such corrective action may include the assessment of additional charges or termination of this Agreement, which actions may be taken is in CNL’s sole and absolute discretion. If CNL takes any corrective action under this section, Customer shall not be entitled to a refund of any fees paid in advance prior to such action.

  14. Disclosure to Law Enforcement: CNL may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition, CNL shall have the right to terminate all service set forth in this Agreement.

  15. Pornography: It is absolutely forbidden to host pornographic content or IRC servers on your CNL account.

  16. Responsibility for Content: You, as CNL’s customer, are solely responsible for the content stored on and served by your website.

Domain Name Registration:

  1. Responsibility: CNL will register client’s requested domain name with a valid domain registrar, such as Network Solutions, Register.com etc. However, CNL will not be responsible as to the availability of domain names. The registration will be valid for specified period as mutually agreed and client will be responsible for all subsequent renewals.

  2. Separate contract: Registration of a domain name for client may require CNL to enter into a separate contract with a certified registering agent.

  3. Free from liability: Any issues arising regarding the domains CNL cannot be held responsible for this.

General:

  1. Payment: Full and final payment must be made at the time of signing the contract. All payments should be made by crossed account payee cheques/demand drafts drawn in favour of CYBERVOX NETWORK LIMITED.

  2. All disputes arising between CNL and the client will be solved as per Indian Arbitration Act; subject to the Ahmedabad jurisdiction.

  3. Discontinuation of agreement: If this agreement is discontinued the client will not be liable to claim any amount.

  4. Duration of acceptance: All bills received by the client and not disputed within 30 days of receipt thereof will only be treated as accepted.

  5. Interest rate: If the client does not make the payment within the stipulated period, as mentioned earlier, he will be liable to pay interest at the rate of 12% per annum, and CNL will have the liberty to suspend his web site/application or any other activity.

  6. Tour cost: CNL will charge actual tour cost, if the client requires meeting with technical/development team at the client’s place.

  7. Taxes will be extra, wherever applicable.
